Welcome to the website established by plaintiffs’ counsel in the class action case Archuleta et al. V. United States, Case No. 99-205C, in the United States Court of Federal Claims. This is a class action lawsuit brought on behalf of all federal employees who retired, died, or separated between April 7, 1993 and September 7, 1999 from employment by any one of 17 federal agencies that are listed below, and who upon retirement, death, or separation were eligible for a lump-sum payment for unused annual leave, as more specifically described here. This site is intended to inform class members about the settlement of this litigation with the United States government.

 

CHECKS ISSUED ON JANUARY 25, 2008

All class members who filed a timely claim, and have not already received a denial letter, will receive either a check or letter.

PLEASE WAIT AT LEAST TWO WEEKS FOR MAIL DELIVERY

 All checks issued to class members who submitted valid claims will represent their award, including wages and interest, less appropriate taxes and withholdings.  With the exception of payments made to the successors of a deceased class member, all payments are income for federal, state, and local tax purposes and have been reported to the taxing authorities. You may be required to make additional tax payments.  Please consult a tax advisor to determine your tax liability and payment obligations.  You will be sent a Form W-2 wage statement and a Form 1099-INT in January 2009, if applicable.
